A.   Responsible party

The website find.content.audi is maintained by AUDI AG, Auto-Union-Straße 1, 85057 Ingolstadt, imprint@audi.de, listed in the register of companies of the District Court of Ingolstadt under HR B 1 (“AUDI AG”). We inform you below about the collection, processing and use of your data.

 

B.   Processing of your personal data

I.             Processing of log files

When you visit our website, we process the following log files relating to you; these files contain no personally identifiable information and hence cannot be traced back to you:

1.            The operating system and web browser you are using, and your selected screen resolution

2.            The date and time of your visit

II. Processing of personal data when ordering marketing material

This website offers you the possibility to download marketing material (such as pictures and videos). The billing is based on the annual usage fee. The following personal data relating to you are stored for this purpose: last name, first name, salutation, brand, IDP ID, AUDI AG contact person, country, and email address. These data shall only be used by AUDI AG for the purpose of initiating, specifying the content of or amending a contract concluded between you, and us for ordering marketing material (see Article 6(1) (b) of the GDPR) and to fulfill our reporting duty (§32 UrhG). The date and time when you downloaded the marketing materials shall be recorded. The data collected shall be stored for two purposes following completion of the download. Firstly, to be able to prepare automated annual reporting to all authors and content creators (§32 UrhG).

The second reason concerns potential litigation against AUDI AG. If the marketing material is definitively used unlawfully and results in litigation against AUDI AG, we are entitled to report the individuals who downloaded the relevant marketing material to the AUDI Legal department. Because legal disputes may also arise following the expiry of the tax-related retention period, the annual download lists shall be stored for 45 years from the date of creation.

The user may be contacted by AUDI AG if one or more assets that he has downloaded from find.content.audi are recalled or subsequently turn out to be faulty.

We forward personal data to third parties, employed by us and acting on our behalf, only insofar as this is necessary, particularly for executing the contract, or if we have to provide information in the context of legal disputes.

C.   Using tracking tools

I.             General information

AUDI AG uses various cookies on its websites. Cookies are small files containing configuration information and are saved on your computer. Cookies can essentially be divided into three categories. There are cookies that are essential for the functionality of the website (referred to as functional cookies), cookies that make it easier to use a website and, for example, save your language settings (referred to as convenience cookies), and cookies on the basis of which a pseudonymised user profile is created (referred to as tracking cookies).

Functional cookies have to be processed to allow you to visit the website (see Article 6(1) (b) of the GDPR).

The legal basis for the use of convenience cookies in the sense of Article 6(1) (f) of the GDPR is the existence of legitimate interest. The provision of a convenience when using a website constitutes the legitimate interest in this regard. You may withdraw your consent to the processing of the data at any time with effect going forward by preventing the storage of cookies through changing your browser settings.

Tracking cookies are only used if the website visitor has consented to this (see Article 6(1) (a) of the GDPR). Consent is provided via the cookie banner, which has to be actively clicked to do this.

II.            Adobe Analytics

This website uses the Adobe Analytics web analytics service to evaluate user access to this website. Data are processed on the basis of the consent provided by you (see Article 6(1) (a) of the GDPR).

For the purpose of evaluation, cookies are stored on your computer to collect information, which is also stored on the servers of our data processor Adobe Systems Software Ireland Limited ("Adobe"). Access to the information by Adobe Systems Incorporated, based in the USA, cannot be ruled out, with the result that corresponding standard EU data protection clauses have been put in place as appropriate guarantees relating to data processing in non-European countries. As part of access/information, you have a right to be notified of this standard contract.

It is not possible to link the information stored on the Adobe servers directly to a specific person since Adobe Analytics is used with the “Before Geo-Lookup: Replace visitor’s last IP octet with 0” and “Obfuscate IP-Removed” settings selected. The “Before Geo-Lookup: Replace visitor’s last IP octet with 0” setting ensures that the IP address is anonymised before this geolocalisation by replacing the final octet of the IP address with zeroes. For the purpose of statistical evaluation, the user’s approximate location is added to the tracking package, which still contains the full IP address. Before the tracking package is saved, the IP address is then replaced with an individual, fixed IP address – referred to as a generic IP address – if the “Obfuscate IP-Removed” setting has been configured. This means that the IP address is no longer contained in a data set that is saved.

 

D.   Your rights

You may exercise the following rights vis-a-vis AUDI AG at any time free of charge. Please refer to Section G for further information on exercising your rights.

Right to information: you have the right to receive information from us about how your personal data are processed.

Right to rectification: You have the right to require us to correct any personal data relating to you that are incorrect or incomplete.

Right to erasure: You have the right to request the erasure of your data, provided the preconditions stated in Article 17 of the GDPR have been met. For example, you may ask for your data to be deleted if they are no longer necessary for the purposes for which they were collected. You may also ask for your data to be deleted if we process your data based on your consent and you withdraw that consent.

Right to restriction of processing: You have the right to ask for a restriction of the processing of your data if the conditions set out in Article 18 of the GDPR are met. That is the case, for example, if you dispute the accuracy of your data. You can then demand a restriction of the processing for the period it takes to verify the accuracy of the data.

Right to object: You have the right to object to the processing of your data if the processing is based on an overriding interest or if your data are used for the purpose of direct marketing. An objection is permitted if processing is conducted in either the public interest or for the exercise of official authority or if it is conducted for a legitimate interest of AUDI AG or of a third party. If you object to the processing of your data, please notify us of the grounds for your objection. You also have the right to object to data processing for the purpose of direct marketing. The same applies to profiling, insofar as it is related to direct marketing.

Right of data portability: You have the right to receive your data in a structured, commonly used, and machine-readable format and to transfer these data to another data processor, provided that data processing is based on consent or contract fulfillment and that automated processing methods are used.

Right of withdrawal: Provided data processing is based on your consent, you have the right to withdraw that consent to the processing of your personal data free of charge at any time, and with effect for the future.

Right to lodge a complaint: You also have the right to lodge a complaint about our processing of your data with a supervisory authority (such as the Bavarian State Office for Data Protection [Bayerisches Landesamt für Datenschutzaufsicht]).
